Website Template Terms & Use

By purchasing and using a The Modern Designer Studio LLC website template, you agree to the following terms:
1. License & Usage
Each template purchase includes a Personal Use License, which grants you a non-exclusive, non-transferable license to use the template for one (1) personal or business website.
You may:
Customize the template to fit your brand
Use it for your own business or personal website
You may not:
Resell, redistribute, sublicense, or share this template (or any modified version)
Use this template for client work without the appropriate license
Use this template to create derivative templates for sale without a Commercial Resell License
Claim the design, layout, or structure as your own original work
Each website requires its own template purchase.
2. Attribution Requirement
By default, you agree to retain visible design credit in the footer of your website in the form:
“Template design by The Modern Designer Studio LLC.”
This attribution must remain clearly visible and accessible on all live versions of the website using this template.
3. Additional License Options
In addition to the included Personal Use License, the following additional licenses are available for expanded usage rights:
Single Credit Removal License — allows removal of the required footer attribution for one (1) personal use website
White Label License — allows use of templates for client projects and removal of the required footer attribution across multiple websites
Commercial Resell License — allows you to modify and resell templates as your own product, subject to the conditions outlined in these Terms
Unless a valid Credit Removal License or White Label License is purchased, removal, modification, or concealment of the required footer attribution is strictly prohibited.
Important:
Each website or resale product must be based on a legally purchased template.
4. Single Credit Removal License
The Single Credit Removal License applies to one (1) personal use website using one (1) template.
You may:
Remove the required footer attribution from a single personal use website
You may not:
Apply this license to multiple websites
Use this license for client projects
Transfer or reuse this license across projects
A separate Single Credit Removal License must be purchased for each additional website.
5. White Label License (Client Use)
The White Label License is intended for service-based use.
You may:
Use templates for client projects
Customize and deliver completed websites to clients
Remove the required footer attribution
You may not:
Resell or distribute the template files
Provide the template as a standalone product
Claim the original design as your own work
Each client website must still purchase its own template.
6. Commercial Resell License
The Commercial Resell License grants permission to modify and resell templates as your own product, subject to the following conditions:
The template must be significantly modified
The final product must not be substantially similar or recognizable as the original template
The original template may not be resold as-is
You may:
Modify the design, layout, and structure
Rebrand and sell as your own product
You may not:
Resell or distribute the original template without meaningful modification
Sell minimally altered versions that closely resemble the original
Claim the original design as entirely your own work
This license grants resale rights but does not transfer ownership of the original design.
7. Intellectual Property
All templates, designs, layouts, and included assets remain the intellectual property of The Modern Designer Studio LLC.
Your purchase grants a license to use the template—not ownership of the design.
8. Refund Policy
Due to the digital nature of this product, all sales are final.
No refunds, exchanges, or cancellations will be issued once access to the template has been delivered.
9. Platform Requirements
These templates are designed specifically for use on Squarespace.
To use your template, you will need:
An active Squarespace subscription
A domain name (purchased or transferred)
You are solely responsible for maintaining your subscription and domain.
10. Support & Customization
Your purchase includes access to the template as delivered.
Unless otherwise stated, this does not include:
Custom design services
Copywriting
Ongoing technical support
Additional services may be available separately.
11. Installation & Setup
You will receive a pre-launch checklist to install and use your template.
You are responsible for:
Adding your own content, images, and branding
Following the provided setup instructions
The Modern Designer Studio LLC is not responsible for issues resulting from user edits, third-party tools, or improper installation.
12. No Guarantee of Results
While these templates are designed with strategy and best practices in mind, we do not guarantee specific results, including but not limited to:
Increased traffic
Client inquiries or conversions
Search engine rankings
Your results depend on your own content, marketing, and business practices.
13. Limitation of Liability
To the fullest extent permitted by law, The Modern Designer Studio LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use—or inability to use—this template.
This includes, but is not limited to:
Loss of revenue or profits
Business interruption
Website errors or downtime
14. Dispute Resolution & Governing Law
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, without regard to its conflict of law principles.
Good Faith Negotiation
In the event of a dispute, both parties agree to first attempt to resolve the matter through good faith negotiation.
Mediation / Arbitration
If a resolution cannot be reached through negotiation, the dispute shall be submitted to binding mediation or arbitration in the State of California.
Attorney’s Fees
The prevailing party in any dispute shall be entitled to recover reasonable attorney’s fees and related costs.
15. Unauthorized Use
Any unauthorized use, reproduction, or distribution of this template may result in legal action.
16. Updates to Terms
These terms may be updated at any time without prior notice. Continued use of the template constitutes acceptance of the current version.
